FugglyDog.com Terms and Conditions

Please read this document carefully as it affects your rights and liabilities under the law and sets out the terms under which FugglyDog.com provides any products or services made available through the fugglydog.com website.

1. Use of FugglyDog.com

fugglydog.com is operated and maintained by Saucy Monkey. All products and services made available through the fugglydog.com website are provided by Saucy Monkey. Registration is not required, but by placing an order you agree to be bound by these Terms and Conditions.

Specific services made available through fugglydog.com may be subject to additional terms and conditions, which will apply concurrently to these Terms and Conditions

2. Amendments

Saucy Monkey may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you when you placed your order or via a suitable announcement on the fugglydog.com website. If you do not wish to accept the new Terms and Conditions you should not continue to use fugglydog.com. If you continue to use the fugglydog.com website after the date on which the change comes into effect, your use of the fugglydog.com website indicates your agreement to be bound by the new Terms and Conditions.

3. Prices

The t-shirts shipping price is $6 per tshirt anywhere in Canada. If your order is from another country we will contact you before billing takes place to ensure you agree to the shipping cost.

4. Acceptance

There will be no contract of any kind between you and Saucy Monkey unless and until Saucy Monkey actually dispatches the goods to you. Your order is an offer to buy from fugglydog.com. Nothing that Saucy Monkey does or says will amount to any acceptance of that offer until fugglydog.com dispatches the goods to you. At any point up until then, fugglydog.com may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and Saucy Monkey, and you will be charged for the goods.

5. Shipping

shipping will be made to the address specified by you on the completed order form. Fugglydog.com will aim to deliver goods as stated but cannot guarantee shipping by such a date.

6. Cancellation

If you order goods, you have the right to cancel your order up to 7 working days after the day following the shipping of the goods. In the event that the goods have already been dispatched at the date of receipt of your cancellation of the order you must return the goods and Saucy Monkey will credit your credit or debit card with the price of the goods within 30 days beginning with the day on which notice of cancellation was given.

If you do not return the goods within 21 days of your cancellation, Saucy Monkey will make a charge in respect of the cost of recovering the goods. If you do not return the goods or fail to make them available for collection within 30 days of your notice of cancellation, you will be deemed to have accepted the goods, at which point a new purchase contract will be made and you will be charged for your order at the price set out on fugglydog.com.

If your order is for the provision of services, please note that you will be unable to cancel the contract once performance of the services has begun.

This does not affect your statutory rights.

7. Returns

You can return any purchase for goods within 30 days of the date the goods are received for any reason, on the sole condition that any item is returned to Saucy Monkey in its original condition. Saucy Monkey will issue a full refund for the price that was paid for the item.

You have the right to return a faulty item within a reasonable period of time, but please keep any warranty information that accompanies the item as this will be needed should there be a fault.

If you take shipping of a purchase from Saucy Monkey and the contents have been damaged in transit, you may return the item(s) to Saucy Monkey within 30 days of receipt for an exchange.

If you return an item because of an error on Saucy Monkey's part or because it is defective, Saucy Monkey will be happy to refund the shipping charges incurred in sending the item to you and the costs of returning it to Saucy Monkey. If cancelling the purchase under the statutory 7 working days cooling-off period, Saucy Monkey will refund the normal postage charge for the shipping of that item but cannot refund any express or courier postage charge. You will be responsible for those charges and the costs of any other services provided in connection with your purchase.

9. Intellectual property

The content of the fugglydog.com website is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the fugglydog.com website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the fugglydog.com website.

No licence is granted to you in these Terms and Conditions to use any trade mark of Saucy Monkey or their affiliated companies including, without limitation, the trade mark Saucy Monkey.

10. Availability of the fugglydog.com website

Although Saucy Monkey aims to offer you the best service possible, Saucy Monkey makes no promise that the fugglydog.com website will be fault free and available at all times. If a fault occurs in the service you should report it to webmaster@fugglydog.com and Saucy Monkey will attempt to correct the fault as soon as reasonably possible.

Your access to fugglydog.com may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Saucy Monkey will attempt to restore the service as soon as it reasonably can.

11. Liability

Due to the standardised nature of the products and services made available through fugglydog.com, Saucy Monkey cannot guarantee that such products and services will meet your precise needs or circumstances. You must also bear the risks associated with the use of the Internet.

Saucy Monkey disclaims all liabilities in connection with the following:

• incompatibility of the fugglydog.com website with any of your equipment, software or telecommunications links
• advice and opinions expressed on fugglydog.com website
• the suitability of the content, usability and impact on your systems of any product downloaded from the fugglydog.com website

You agree that Saucy Monkey will not be liable to you or any third party for any consequential or incidental loss or damage including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other direct, indirect, special or punitive damages whatsoever that arise out of or are related to the use of fugglydog.com.

Nothing in these Terms and Conditions shall exclude Saucy Monkey’s liability for personal injury or death caused by its negligent act or omission or wilful misconduct or any other liability which cannot by law be excluded or restricted.

12. Data protection

All personal information collected via voodoochick.com will be used in accordance with the Privacy Policy.

13. General

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and Saucy Monkey ignores this, Saucy Monkey will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions

Saucy Monkey shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this will not affect any right or remedy of a third party which exists or is available apart from that Act.
